1. Permitted Use

Everinbox is designed for legitimate, permission-based email communication, including:

  • Marketing and promotional emails sent to subscribers who have opted in
  • Transactional emails (order confirmations, receipts, password resets, shipping notifications)
  • Newsletters and editorial content
  • Notification emails (account alerts, service updates)
  • B2B outreach where there is a pre-existing business relationship or legitimate interest

2. Prohibited Activities

The following activities are strictly prohibited on the Everinbox platform:

  • Sending unsolicited bulk email (spam) as defined in our Anti-Spam Policy
  • Distributing malware, spyware, ransomware, or any malicious code
  • Conducting phishing attacks or social engineering campaigns
  • Impersonating any person, company, or organization you do not represent
  • Sending email that violates the CAN-SPAM Act, LGPD, CASL, GDPR, or any other applicable anti-spam or data protection law
  • Publishing or transmitting hate speech, content promoting violence, or content that discriminates based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
  • Distributing sexually explicit content to recipients who have not verifiably consented
  • Facilitating illegal activity of any kind, including fraud, money laundering, or violation of export controls
  • Interfering with or attempting to compromise the security, integrity, or availability of the Everinbox platform or any other system
  • Reselling or subletting Everinbox services without written authorization
  • Using the platform in any way that disproportionately burdens its infrastructure

3. Restricted Industries

The following industries require pre-approval from our compliance team before activating a sending account. Contact [email protected] before registering:

  • Adult content — sexually explicit or suggestive material, adult entertainment
  • Online gambling and sports betting — regulated in most jurisdictions
  • Pharmaceuticals and dietary supplements — including prescription drugs and controlled substances
  • Cryptocurrency, NFTs, and digital assets — including exchanges, wallets, and investment products
  • High-risk financial products — payday loans, cash advances, debt settlement services
  • Firearms and ammunition — including accessories and modification kits
  • Multi-level marketing (MLM) — business opportunities with chain-recruitment structures
  • Political campaigns — federal, state, and local election communications in Brazil

Approval is granted on a case-by-case basis. Everinbox reserves the right to deny or revoke approval for any sender in these categories.

4. Data and Privacy

You are responsible for ensuring that your use of Everinbox complies with all applicable data protection laws, including the LGPD (Brazil), GDPR (EU), and CAN-SPAM (US). Specifically:

  • You must have a lawful basis (consent, legitimate interest, or contract) for processing recipients' personal data.
  • You must not send personal data of EU or Brazilian residents to Everinbox without ensuring appropriate data protection agreements are in place. Our Data Processing Agreement (DPA) is available upon request.
  • You must not upload or process sensitive personal data (health, financial, biometric, government ID, data of minors) through the platform without explicit recipient consent and compliance with applicable law.
  • You are the data controller for your subscriber lists. Everinbox acts as a data processor on your behalf.

5. Suspension and Termination

Everinbox reserves the right to take the following actions when it suspects or confirms a violation of this AUP:

  • Immediate sending suspension — without notice, if we detect activity that poses an imminent risk to the platform, other senders, or recipients
  • Formal warning — for first-time or borderline violations, with a 48-hour remediation window
  • Feature restriction — limiting specific capabilities (e.g., high-volume sending, SMS, API access) pending investigation
  • Account termination — for confirmed, serious, or repeated violations; no refund will be issued for the current billing period

6. Reporting Violations

If you observe activity on the Everinbox platform that you believe violates this policy, please report it at policy.everinbox.com.br/pt-br/abuse-prevention or email [email protected].

7. Policy Updates

Everinbox may update this AUP from time to time. For material changes, we will provide at least 30 days' notice via email to the address on file for your account. Continued use of the platform after the effective date constitutes acceptance of the updated policy.
